The judicial system is made up of entities that serve to prevent, detect, prosecute, judge and regulate criminal activities. Globally, justice systems aim to simultaneously ensure the safety of citizens without violating citizens' rights. The Due Process model is a model that recognizes that the State must respect all of a person's legal rights when exercising justice. The due process model challenges the criminal justice system to determine whether there is a miscarriage of justice, as highlighted in Regina (Rottman) v. Metropolitan Police Commissioner. In this case it was questioned whether there had been a breach of section 8 of the Human Rights Act by the police in respect of the appellant, whereby the police had overextended their common law power in carrying out a search and a seizure without a warrant. In the case of Rottman v Commissioner of Police of Metropolis, Mr Michael Rottman (the appellant), a German businessman, was allegedly involved in fraudulent activities involving an East German electricity company. The applicant was accused of having access to stolen funds and had not resided in Germany since 1995, subsequently on 27 December 1996 a German court issued an arrest warrant against him. On 13 September 2000, the German authorities submitted a request to the Metropolitan Police via Interpol for the extradition of Mr Rottman to Germany. The appellant was resident in the south of England at the time the extradition request was issued. A provisional arrest warrant was issued for alleged conspiracy to defraud on 22 September 2000 at Bow Street Magistrates Court under section 8(1) of the Extradition Act 1989. Following police investigation and surveillance , Mr Rottman was located in Henley- on the Thames, on 23 September 2000...... half of the document ......d the protection of society and the efficient implementation of the justice system by the police. The justice system proved to be effective as the applicant used the due process model and sought redress where he believed his rights had been violated by the authorities. The appellant was granted a fair trial by the House of Lords. The interpretation of the law, particularly PACE, regarding the common law power extended to police officers, leaves some ambiguity. The legislation was enacted in 1984 and may be subject to review or further amendments to provide greater clarification on the scope as it relates to extradition and the evolution of cross-border crimes such as cyber terrorism. I totally agree that the due process model is a fundamental principle of any criminal justice system for the safety of all individuals in a democratic society .
