Both Gallagher and MacDonald were aware of the situation and that the company was not meeting its contract deadline. When Davis first asked Gallagher about calculating the credit amount for open positions, Gallagher said he had not raised the issue during his last meeting with Symbol and told him to choose the lowest cost and MacDonald said to do the same. Gallagher negotiated the contract with Symbol and was certainly aware of the agreement made. He knew that from Symbol's perspective, ConnectCo was paid to provide qualified IAEs and manage the hiring, retention, scheduling and training of those IAEs. When Davis raised concerns about the contract and their accounting practices during their meeting, Gallagher told Davis to stop thinking like a customer and eliminate training days from their calculations. This shows that Gallagher was aware of the customer's concerns and ConnectCo's responsibility to meet the customer's needs, but was not interested in doing so and was only concerned with the ConnectCo side
